Terms and conditions chess lessons after school provided by 040schaakt
This is a translation of the "algemene voorwaarden" on the Dutch part of this website, in case of confusion the Dutch translation is leading.

1. Enrolment
a. Enrolling for chess lessons is possible through the online enrolment form on the website of 040schaakt.
b. The enrolment is only finalized when the payment is fulfilled.
c. 040schaakt reserves the right to refuse enrolment when there is no available spots or any other reason that is deemed valid by 040schaakt.
d. Parents / guardians are requested to provide 040schaakt with all necessary or useful information to teach the chess lessons as best as possible.
2. Lesson payments
a. The required payment will be determined before the start of the course and communicated to the participants.
b.Participants will receive a payment request or invoice with the payment amount and payment term after their enrolment.
c.The required payments should be paid within the payment term, as provided in the payment request of invoice.
3. Late payments
a. In case of late payments, 040schaakt reserves the right to charge additional costs. These costs could be administration costs or other reasonable costs that are a result of the collection of the remaining payment.
b. In case an outstanding payment and possible additional costs are not fulfilled within a reasonable term after the expiration date, 040schaakt could decide to terminate the participation in the chess lessons until payment is fulfilled.
c. The termination of the participation in the chess lessons does not exempt the participant of the requirement to complete the payment after all. Possible missed lessons as a consequence of late payments will not be compensated.
d.In case of special circumstances that lead to the late payments, we request the participants to reach out to 040schaakt in a timely manner to come to a fitting solution together. We are open for communication and would like to work towards a solution together.
4. Cancellation and restitution
a. In case of cancellation before the start of the chess lessons, the entire payment for the chess lessons will be paid back.
b. Cancellation after the start of the chess lessons do not give right to restitution of the lesson payments, unless there are exceptional circumstances that warrant restitution in the eyes of 040schaakt.
5. Liability
a. 040schaakt and affiliated chess teachers are not responsible for any form of damage, injury or loss of personal items of partipants of the chess lessons or on the premice of the school where the chess lessons take place.
b. Parents / guardians are responsible for the safe arrival and departure of their children to and from the chess lessons.
c. 040schaakt cannot be held responsible for children who are not picked up on time.
6. Rules of conduct
a. We expect the participants to act friendly and with respect in their contact with teachers, fellow students and others.
b. Bad language, bullying, discrimination or other unacceptable behaviour is not permitted.
c. We expect that students listen to chess teachers and their direction is followed during the lessons. They are there to keep the chess lessons fun and safe for everyone!
7. Additional rules
a. During the chess lessons we follow the rules of the school / location where we are.
b. Every participant will get their own book in which they can practice on their own level. We would like everyone to treat the materials of the school and 040schaakt, including your own workbook, respectfully.
c. In case of bad misconduct 040schaakt will contact parents / guardians and discuss together the possible solution to prevent repetition of this misconduct.
d. In case of repeated misconduct 040schaakt can decide to prevent the participant from enrolling in future chess lessons.
8. Lesson schedule
a. The lesson schedule will be communicated before the start of the chess lessons.
b. 040schaakt keeps the right to change the schedule if necessary. Participants will be kept up to date in a timely fashion
c. In case of unforeseen circumstances, like pandemics (for example COVID-19), natural disasters, strikes or other circumstances that make it impossible to teach the chess lessons on location, 040schaakt will try its best to catch up on these at a later date or to provide an online alternative.
9. Group composition
a. The amount of participant per lesson group can vary, depending on level of the participant, available space and available trainers.
b. 040schaakt strives towards creating groups based on comparable chess level and to offer all participant as much challenge on their own level.
10. Photo's and video's
a. 040schaakt can make photo's and video's during the chess lessons to give an impression of the activities and atmosphere during the chess lessons.
b. To share photo's and video's in the chat groups of that lesson group 040schaakt will ask permission from parents / guardians of participants in the enrolment form.
c. The photo's and video's will only be shared in the chat groups of that lesson group if parents / guardians gave permission at the enrolment of the chess lessons.
d. 040schaakt will not use the photo's and video's for any other uses that promotional ones within the chat groups of the chess lessons unless they have written consent from parents / guardians.
11. Applicable law
a. On these therms and condition, Dutch law is applicable.
b. In case of differences, only a qualified judge in the Netherlands has jurisdiction.
By enrolling in the chess lessons of 040schaakt, the participant (and their parents / guardians) agree with the terms and conditions above.
